Welcome to Hockaday Rx ("we," "us," "our," or "Company"). By accessing or using the website www.hockadayrx.com (the "Site") or any services provided by Hockaday Rx, LLC (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS SITE OR SERVICES. These Terms constitute a legally binding agreement between you and Hockaday Rx.

1. About Hockaday Rx

Hockaday Rx, LLC is a pharmacist-led sports pharmacy consulting practice formed in the State of California in March 2026, based in Inglewood, California. Our services include pharmacist consultations, supplement safety guidance, sports compliance education, and research-backed wellness content. All pharmacist services are provided by or under the supervision of Brandon Hockaday, PharmD, a licensed pharmacist in the State of California.

Hockaday Rx does not operate as a retail pharmacy or dispensing facility, does not prescribe medications, and does not provide medical diagnoses. Our services are complementary to — and do not replace — the care of your physician or other licensed healthcare providers. Services may be subject to limitations based on your state of residence.

2. Eligibility

You must be at least 18 years of age to use our website or engage our services. By using our Site, you represent that you are 18 or older and have the legal capacity to enter into these Terms. If you are under 18, you may only use our services with the consent and supervision of a parent or legal guardian. See Section 12 for youth athlete provisions.

3. Nature of Services

3.1 Educational and Consultative Services

Hockaday Rx provides pharmacist consultation, supplement analysis, medication review, and educational resources related to athletic performance, WADA compliance, and sports pharmacy. All Services are provided for educational and consultative purposes only.

3.2 Not a Pharmacy or Medical Provider

Hockaday Rx does not:

Operate as a retail pharmacy or dispense prescription medications
Diagnose, treat, cure, or prevent any disease or medical condition
Provide emergency medical services
Replace the advice of your physician or other licensed healthcare provider

3.3 Ask the Pharmacist Feature

The Ask the Pharmacist feature allows users to submit general questions related to supplements, sports performance, and pharmacy topics. Use of this feature does not establish a formal pharmacist-patient relationship and does not constitute a paid consultation. Responses are educational in nature. For personalized guidance involving your specific medical history, medications, or health conditions, a formal consultation must be booked separately.

3.4 No Pharmacist-Patient Relationship

Unless you have formally engaged Hockaday Rx through a paid consultation and executed a separate service agreement, no pharmacist-patient relationship exists between you and Brandon Hockaday, PharmD, or Hockaday Rx. General information on this Site — including content published through The Scoop newsletter, Ask the Pharmacist responses, or the Research Hub — does not create a professional relationship.

3.5 Clean Sport and WADA Compliance Guidance

We provide general education on WADA prohibited substance lists, anti-doping regulations, and clean sport compliance. This guidance is educational in nature. We are not affiliated with, endorsed by, or representing WADA, USADA, NCAA, or any sports governing body. Anti-doping regulations change frequently, often annually. Final responsibility for anti-doping compliance rests solely with the athlete. We are not liable for anti-doping violations, failed drug tests, competition disqualifications, or sanctions resulting from your use of supplements or medications. Athletes are strictly liable for all substances in their bodies under most anti-doping codes.

3.6 No Products for Sale (Current Stage)

As of the effective date of these Terms, Hockaday Rx does not operate an e-commerce store or sell products directly through the Site. If and when product offerings are introduced, separate purchase terms and refund policies will govern those transactions.

4. No Medical Advice

All content on this Site — including blog posts, articles, FAQs, guides, downloadable resources, newsletter content, and Ask the Pharmacist responses — is provided for informational and educational purposes only. This content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition, prescription medications, dietary supplements, or treatment plans. Never disregard professional medical advice or delay seeking it because of information you read on this Site.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this Site or contact Hockaday Rx for emergency medical situations.

5. Supplement and Medication Reviews

5.1 No Guarantee of Results

Hockaday Rx makes no guarantees, warranties, or representations regarding athletic performance outcomes, competition results, health improvements, weight loss, muscle gain, or other physical changes; prevention of anti-doping violations (though we use industry-standard verification methods); or supplement efficacy or safety.

5.2 Third-Party Product Liability

Hockaday Rx does not manufacture, sell, or distribute supplements or medications. We are not responsible for manufacturing defects, product contamination (including batch-to-batch variation), inaccurate product labeling by manufacturers, adverse reactions to products, or product recalls or safety alerts.

5.3 Independent Verification Recommended

While we use industry-standard verification methods including third-party certifications such as NSF Certified for Sport and Informed Sport, athletes competing at the Olympic or professional level should consider independent laboratory testing of all supplements before consumption.

6. User Responsibilities

6.1 Accurate Information

You agree to provide accurate, current, and complete information when scheduling consultations, submitting supplement lists for analysis, completing intake forms, or communicating with Hockaday Rx. Inaccurate or incomplete information may result in incomplete or incorrect guidance.

6.2 Required Disclosures

During consultations, you must disclose all current medications (prescription and over-the-counter), all dietary supplements and herbal products, all medical conditions, allergies, and prior adverse reactions, and any changes to the above during our engagement. Failure to disclose complete information may result in unsafe recommendations and increased health risks.

6.3 Healthcare Provider Guidance

If your physician, sports medicine doctor, or other licensed healthcare provider gives you advice that conflicts with Hockaday Rx recommendations, follow your licensed healthcare provider's advice. Hockaday Rx recommendations are consultative and should be discussed with your treating physician before implementation.

6.4 Prohibited Uses

You agree NOT to use the Site or Services to:

Seek emergency medical advice or urgent care
Obtain prescriptions for controlled substances or medications
Circumvent anti-doping regulations or facilitate doping violations
Misrepresent your identity, medical history, or intentions
Submit false, misleading, or fraudulent information
Interfere with or disrupt the Site or its infrastructure
Violate any local, state, federal, or international laws

7. Payment, Cancellation, and Refunds

7.1 Payment Terms

Payment for Services is due at the time of booking unless otherwise agreed in writing. All fees are in U.S. Dollars (USD). We accept payment via credit card, debit card, and other electronic payment methods as specified at checkout.

7.2 Cancellation Policy

Consultations may be rescheduled with at least 48 hours' notice at no charge
Cancellations with less than 48 hours' notice will be charged 50% of the consultation fee
No-shows (failure to attend a scheduled consultation) will be charged 100% of the consultation fee

7.3 Refund Policy

All sales are final. We do not provide refunds for completed consultations or services, or downloadable digital products after download. Refunds may be issued at our sole discretion if services were not delivered due to our error, or if technical issues prevented service delivery and could not be resolved. Refund requests must be submitted in writing to hello@hockadayrx.com within 7 days of the service date.

8. Intellectual Property

8.1 Ownership

All content on this Site — including text, graphics, logos, images, videos, research summaries, newsletter content, educational materials, and downloadable resources — is the property of Hockaday Rx, LLC or its content creators and is protected by applicable intellectual property laws. "Hockaday Rx," our logo, and other marks are trademarks of Hockaday Rx, LLC. Unauthorized use is prohibited.

8.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and downloadable materials for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from Site content; use content for commercial purposes without written permission; remove copyright or proprietary notices; or scrape, data-mine, or automate access to Site content.

Limited quotation with attribution for editorial or educational purposes (such as citing our research summaries) is permitted, provided it does not misrepresent our positions or services.

8.3 User-Generated Content

If you submit testimonials, reviews, or feedback, you grant Hockaday Rx a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and display your content in marketing materials, on the Site, and in other promotional contexts. You may not submit content that is false, misleading, defamatory, or violates any third party's rights. We reserve the right to remove any user content at our discretion.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free; that defects will be corrected; that the Site is free from viruses or harmful components; or that information on the Site is accurate, complete, or current.

Hockaday Rx makes no representations or warranties regarding athletic performance improvements, competition eligibility, prevention of injury or adverse reactions, or anti-doping compliance outcomes.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOCKADAY RX, LLC, ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, PERSONAL INJURY, PROPERTY DAMAGE, ADVERSE REACTIONS TO SUPPLEMENTS OR PROTOCOLS, OR ANTI-DOPING VIOLATIONS OR COMPETITION SANCTIONS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO HOCKADAY RX IN THE 12 MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. Nothing in these Terms limits liability that cannot be excluded by applicable California or federal law.

You acknowledge that use of dietary supplements and medications carries inherent risks, that athletic training and competition carry inherent risks of injury, that anti-doping compliance is your ultimate responsibility, and that you assume all risks associated with your use of the Site and Services.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hockaday Rx, LLC, its founders, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: your use of the Site or Services; your violation of these Terms; your violation of any third-party rights; your use of supplements, medications, or athletic protocols; any anti-doping violations or competition sanctions; or any inaccurate or incomplete information you provided.

12. Children and Youth Athletes

Our Site and Services are not intended for children under 13. Users under 18 may only engage our services with parental or guardian consent. For youth athletes ages 13–17 engaging with clean sport education, youth sport programming, or community events, parental or guardian consent is required for consultations, and we collect only information necessary to provide the requested services.

13. Community Events and In-Person Services

From time to time, Hockaday Rx may host or participate in community events such as flu clinics, educational workshops, youth sport clean sport seminars, or LA 2028 Olympic community programming. Separate terms or waivers may apply to in-person events. Participation is voluntary and at your own risk. Hockaday Rx is not liable for injury or loss arising from attendance at or participation in events, absent direct negligence by Hockaday Rx.

14. Privacy

Your use of our Site and Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. For clients receiving pharmacist consultation services involving protected health information, a separate Notice of Privacy Practices (NPP) will be provided. Information you share during consultations is kept confidential and used solely for the purpose of providing Services, except as required by law or with your written consent.

15. Dispute Resolution

15.1 Informal Resolution First

Before initiating arbitration or legal proceedings, you agree to first contact us at hello@hockadayrx.com to attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15.3 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Los Angeles, California. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

YOU AND HOCKADAY RX AGREE TO WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING WITH RESPECT TO ANY CLAIM ARISING FROM THESE TERMS.

Exception: Either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent irreparable harm.

16. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any separate service agreements, constitute the entire agreement between you and Hockaday Rx regarding the Site and Services.
Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
Force Majeure: Hockaday Rx is not liable for failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, pandemics, or internet service disruptions.
Survival: Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) shall survive termination of these Terms.

17. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last Updated" date above. For material changes, we will provide notice via email or a prominent notice on the Site. Continued use of our website or services after modifications are posted constitutes acceptance of the revised Terms.
